 General Terms & Conditions / Base Tarrifs

1. GENERAL CONDITIONS

General
Unless otherwise agreed, the terms and conditions according to this document shall apply.

Prices
All prices are in NOK exclusive of VAT. Prices can be changed without further notice.

Payment
The payment terms are per 15 days. In cases of late payment, an interest on overdue payment of 1,5% will be added per month or part of the month. For short time lease, Westport Moss AS can ask for advance payment.

Hired services / Expenses for customers
Hired services performed by Westport Moss AS will be charged at actual costs with an addition of +25%.

Delivery
All prices are based on delivery in the harbor.

Equipment
Lease of equipment does not include operator unless specifically agreed.

SmartPort
Westport Moss AS has established our SmartPort concept to make sea transport more attractive. Westport Moss encourages all our customers to connect to our IT solution.

Public Holidays
New Year’s Day, Maundy Thursday, Good Friday, Easter Eve, Easter Sunday, Easter Monday, 1st of May, 17th of May, Ascension Day, 1. Pentecost, 2. Pentecost, Christmas Day, Boxing Day.
For Christmas- and New Year’s Eve and Wednesday before Ascension Day, special rates may apply.

Equipment
In exceptional cases where customers or others are allowed to use Westport Moss AS equipment, documentation or certification for use of such equipment has to be provided. Westport Moss AS shall be indemnified for all such use of equipment.
Any loss or damage has to be reported to Westport Moss AS immediately and latest within 2 weeks after the loss or damage occurred.
Westport Moss AS can, at customer’s cost, assist with obtaining additional insurance for customer if necessary.

Working hours
Normal working hours: Monday to Friday 07:00 to 15:00
Overtime 1 (50%): Monday to Friday 15:00 to 21:00,
Overtime 2 (100%): Monday to Thursday 21:00 to 07:00, and from 21:00 Friday through 07:00 Monday
Note that 100% applies between from 12:00 on Christmas Eve, New Year’s Eve, and the Wednesday prior to Easter.

Gang ordering
Lines must confirm vessel ETA and gang request by 12:00 on the calendar day prior to operations. More advanced confirmation is required for vessels arriving on public holidays or on the day following a public holiday. Gang orders for vessels arriving within contracted and agreed berthing windows will be confirmed by 14:00 on the business day prior to operations. Gang orders for vessels arriving outside of agreed windows will be provided as soon as appropriate labor can be identified. Cancellation of confirmed Gangs: Cancellation of gangs after gangs are confirmed are subject to the following cancellation charges, if outside agreed berthing window:

Documentation and Cargo cutoffs/Electronic communication
For services or operators that are not able to provide COPRAR files, a fee per vessel call will apply. Failure to send information prior to the mentioned cutoff may result in delayed start of operations and associated waiting time charges. Export booking information must be supplied via COPARN messages or alternatively manual updates via the Westport Moss customer portal.

NSAB 2015 is applied on all services performed, with the following exceptions:
§13 (Secrecy), §20 (Cross labeling) and §21D (Declared value) shall not apply.
Unless specifically agreed, Westport will not be liable for any loss of or damage to goods and/or equipment belonging to customers which are in Westport`s custody and/or handled by Westport, unless the loss or damage is caused by gross negligence by Westport.
Maximum liability shall nevertheless not exceed SDR 2 per kilogram of gross weight of Goods lost or damaged. SAB 2015 § 21 A and § 24 B shall hence apply with the reservations above.
Neither Westport nor Moss Havn KF (port owner) are responsible for loss caused by outage, errors or defects on the crane operating the Port (and owned by Moss Havn KF).

Transfer of contract – Rights of Moss Havn KF
Should Westport’s rights to operate the Terminal cease, by claim from Moss Havn KF as owner of the port, Westport has the right to transfer all rights and obligations related to services according to this general tariff to Moss Havn KF.
